Welcome to Scale My Hotel. By accessing our website (scalemyhotel.com), using our free tools, or engaging us for marketing consultation, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Scope of Services

Scale My Hotel is a growth marketing and distribution consultancy specializing in the hospitality industry. Our services include:

• Hotel launch setup packages (Rocket Launch Package)
• Ongoing growth marketing retainers (Scale Phase)
• Dynamic pricing consultation and revenue management
• Search engine marketing (Google Ads, Google Hotel Ads)
• Social media marketing and content creation
• OTA listing optimization and distribution management
• Custom booking engine and website integrations

Our free tools (calculators, audit tools, benchmarking tools) are designed to provide estimates and projections for educational and strategy modeling purposes. They do not guarantee specific revenue increases or financial outcomes.

2. Payment & Billing

All paid services are governed by distinct written scopes of work (SOW) agreed upon before engagement begins.

• Rocket Launch Package: Billed as a one-time fee of ₹75,000 + applicable GST
• Scale Phase Retainers: Billed monthly in advance as per the agreed SOW
• Custom Projects: Billed per the custom proposal terms

Payments are non-refundable once optimization tasks, campaign setup, or deliverable production has commenced. If a project is cancelled before work begins, we will refund the payment minus any administrative costs incurred.

3. Acceptable Use of Free Tools

Our free calculators, audit tools, and downloadable resources are provided for legitimate business use by hotel owners, property managers, and hospitality professionals. You agree not to:

• Scrape, automate, or bulk-extract data from our tools
• Misrepresent tool outputs as professional financial or legal advice
• Redistribute our templates, checklists, or resources without attribution
• Use our tools for competitive intelligence against Scale My Hotel

We reserve the right to implement rate limiting or restrict access to tools if abuse is detected.

4. Intellectual Property

Our property: The code, calculator algorithms, design systems, blog content, benchmark databases, and logos displayed on scalemyhotel.com are the sole intellectual property of Scale My Hotel. Unauthorized reproduction, distribution, or derivative use is prohibited.

Your property: Clients retain full IP ownership over their customized brand graphics, photography deliverables, website content written for their property, and domain names. Upon completion and full payment, all client-specific deliverables are transferred to the client.

5. Confidentiality

Both parties agree to keep confidential any proprietary business information shared during the engagement, including but not limited to revenue figures, pricing strategies, occupancy data, and marketing budgets. This obligation survives the termination of the consulting relationship.

6. Limitation of Liability

Scale My Hotel provides marketing strategy, execution, and technology integration services. We are not liable for:

• Changes in OTA ranking algorithms or policies by third-party platforms
• Google Business Profile suspensions or search engine algorithm updates
• Ad budget losses resulting from operational decisions made by hotel management
• Revenue fluctuations caused by seasonality, local events, or macroeconomic factors
• Third-party platform outages (Booking.com, MakeMyTrip, Google, etc.)

Our total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific engagement in question.

7. Termination & Cancellation

Either party may terminate an ongoing engagement with 30 days written notice. Upon termination:

• Any completed deliverables will be transferred to the client
• Outstanding payments for work already performed remain due
• Active ad campaigns will be paused and access credentials returned
• Confidentiality obligations survive termination indefinitely

For the Rocket Launch Package (one-time engagement), no cancellation applies after work has commenced.

8. Dispute Resolution

These terms are governed by the laws of India. Any dispute arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. Both parties agree to attempt resolution through good-faith negotiation before pursuing formal legal proceedings.

9. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Material changes will be reflected with an updated "Last Updated" date. Continued use of our website and services after changes are posted constitutes acceptance of the revised terms.
